Is the ROC flag the correct flag for Taiwan territory?

Is the ROC flag the correct flag for Taiwan territory? Where is any international treaty which shows that Taiwan has been ceded to the Republic of China? Or where is there any basis in international law for saying that Taiwan belongs to the Republic of China?

Therefore, can it be affirmed that the flying of the ROC flag over Taiwan is a fraud perpetrated on the international community (and the Taiwanese people) by the ROC regime?

Why don't the Taiwanese people stand up for their rights and demand that this ROC flag be removed? Is the ROC flag the correct flag for Taiwan territory?
Taiwan was a territorial cession in the 1895 Treaty of Shimonoseki. After the coming into force of the Treaty, Taiwan was Japanese territory, so of course the Japanese flag flew over Taiwan.

After the events of Aug. 1945, Japan surrendered. The United States was the ';conqueror'; which means it will be the ';principal occupying power.'; In General Order No. 1 of Sept. 2, 1945, Gen. MacArthur directed the military forces of Chiang Kai-shek to go to Taiwan to accept the surrender of Japanese troops.

At the surrender ceremonies, the flag of the principal occupying power should have been raised. Of course, this would be the United States flag. However, the flag of the Republic of China was raised, when in fact the ROC was only a subordinate occupying power.

In December 1949, high officials of the ROC fled from mainland China to occupied Taiwan, thus becoming a government in exile.

In the post-war San Francisco Peace Treaty of April 28, 1952, Japan renounced the sovereignty of Taiwan, but no receiving country was specified for this territorial cession. At that point, the flag of the ROC should have come down, and the flag of the principal occupying power (the USA) should have been flown on the flagpole.

There has been no change in this situation to date.

Hence, the correct flag to be flying over Taiwan is the US flag.Is the ROC flag the correct flag for Taiwan territory?
You are correct. There is no obligation that would force The ROC to use The ROC flag.

The National Flag of the Republic of China (Traditional Chinese: 中華民國國旗; Simplified Chinese: 中华民国国旗; Hanyu Pinyin: Zhōnghuá Mínguó guóqí) is a well-known symbol of the Republic of China (ROC), which since 1949 has been based on the island of Taiwan. It is commonly referred to in Chinese as Blue Sky, White Sun, and a Wholly Red Earth (Traditional Chinese: 青天、白日、滿地紅; Simplified Chinese: 青天、白日、满地红; Hanyu Pinyin: qīng tiān, bái rì, mǎn dì hóng) to reflect its attributes. This design was first used in China by the Kuomintang (KMT) in 1917 and made the official flag of the ROC in 1928.

The current use of the flag is considered by some to be controversial due to the dispute over the political status of Taiwan. Within Taiwan, the flag is widely used as a national flag though there is controversy over its appropriateness. It is actively embraced as a symbol by Chinese reunification supporters as a historical link with mainland China, while a number of Taiwan independence supporters shun the flag for mainly the same reasons. Its use has been opposed by the People's Republic of China (PRC) because it suggests the continued existence of the ROC, which the PRC regards as defunct and to have been succeeded by the PRC in the Chinese Civil War. However, since the early 2000s, the PRC has had a more favorable view toward the flag, as it began to see the use of the flag in Taiwan as symbolizing a connection between Taiwan and mainland China, and news media in the PRC have often criticized supporters of Taiwanese independence for attempting to replace the flag.
No, it should be the chinese flag. no g8 or developed country in the world today disagrees with the '1 child policy'...

Aside from the Japanese occupation, Taiwan has been part of China since the 1670s. Taiwanese are Chinese, just as Hunanese, Hainanese, Honk Kongese, Shanghaiese, etc.

the taiwan riots again in parliament this past week again were hilarious...good fodder for comedy. The KMT has always been a lame duck political party.
